2. These terms
By placing an order or booking on this website you agree to these terms, our Privacy Policy, our Returns & Refunds Policy and our Delivery & Collection terms. Nothing in these terms limits your rights under the Consumer Protection Act, 2008 (CPA) or the Electronic Communications and Transactions Act, 2002 (ECTA).
3. Prices and specials
- All prices are in South African Rand (ZAR) and include VAT where applicable.
- Delivery is charged separately and shown in your cart before you pay (see Delivery & Collection).
- Special prices (for example the Back to School Special) apply only while the special runs and while stock lasts. The end date is shown on the shop page.
- Where an item shows a minimum quantity, the price shown is per unit; the minimum is for guidance.
- We check prices carefully, but if an item is clearly mispriced we will contact you before processing, and you may cancel for a full refund.
4. How an order or booking is made
- You add products, classes, workshops or retreats to your cart and choose courier delivery or collect at class.
- When you click Checkout & pay, your order is saved, class seats are held for 30 minutes, and you are taken to iKhokha’s secure payment page.
- The agreement is concluded once payment succeeds. You will see a confirmation page and receipt, and Ajay is notified straight away.
- If payment isn’t completed within 30 minutes, held seats are released.
5. Payment and security
Card payments are processed by iKhokha, a registered South African payment provider, on their secure (HTTPS) payment page. We never see or store your card details. EFT or cash may be arranged directly with Ajay.
6. Availability
Supplies are ordered from our supplier and are subject to availability. If an item is out of stock after you’ve paid, we will offer a similar alternative or refund you for that item within 30 days.
7. Classes, workshops and retreats
- Booking is for the date and venue shown. Please arrive on time; missed sessions are not refundable.
- Cancellations and transfers by you: see Returns & Refunds.
- If we must cancel or reschedule (for example illness, load-shedding or too few bookings), you may choose a new date, a credit, or a full refund.
- Materials included in a class are listed on the class page. Students attend at their own risk and must follow studio safety guidance. Parents or guardians are responsible for learners under 18 outside class time.
- We may photograph classes and artwork for our website and social media. Tell us if you’d rather not appear.
8. Cooling-off and returns
Your right to cancel online purchases within 7 days (ECTA section 44), and how returns and refunds work, are set out in our Returns & Refunds Policy.
9. Website use
Content, photos and artwork on this site belong to Ajay’s Art or its students and may not be copied without permission. Product images are supplied for identification and may differ slightly from the item. We aim to keep the site available and accurate but cannot guarantee it is always error-free.
10. Liability
To the extent the law allows, we are not liable for indirect or consequential loss. This does not exclude liability that cannot be excluded under the CPA, including for defective goods or gross negligence.
11. Disputes and complaints
Please contact us first; we’ll do our best to resolve any problem quickly. If we can’t, you may approach the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission. These terms are governed by the laws of South Africa.
